My understanding is that he is entitled to the refund. I would say it is not fair, as I filed in August 2008, and so only part of the year's refund should go to the bankruptcy estate. For example, in Oklahoma where I practice, it is nearly unheard of for the debtors to lose property - much less have to buy it back from the trustee. It's like a bunch of vultures circling weak prey or something. My advice is definitely to shred all of those offers and focus on a debt-free future. Then again, I still have a long way to go, financewise, as I shared on my blog ;). Best of luck to you and your wife---things will be okay!
